This information notice is drafted pursuant to Article 13 of Regulation (EU) No 2016/679 (hereinafter ‘GDPR’ or the ‘Regulation’) to provide information regarding navigation data and the operation of cookies and other tracking tools to those who access and navigate the following website:

WHO IS THE DATA CONTROLLER?

ADR S.p.A., with registered office at Via Pier Paolo Racchetti 1, Fiumicino, 00054, is the Data Controller of your personal data (hereinafter ‘ADR’ or ‘Data Controller’).

WHAT IS NAVIGATION DATA?

During their normal operation, the computer systems and software procedures used to operate the Website acquire certain personal data, the transmission of which is implicit in the use of Internet communication protocols.

This information is not collected to be directly associated with identified persons, but by its very nature could indirectly allow identifying users following processing and association with data held by third parties.

This category of data includes the IP addresses or domain names of the computers used by users who connect to the Website, the URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful operation, error, etc.) and other parameters relating to the user's operating system and computer environment.

The data could be used to ascertain responsibility in the event of hypothetical computer crimes to the detriment of the Website: except in this case, the data are kept for the time defined by the reference legislation or, in general, for the time strictly necessary to provide the user with the service requested to guarantee the communication is transmitted.

WHAT ARE COOKIES?

Cookies are text strings downloaded to the user's device and serve numerous purposes, including session tracking, storing information on specific configurations of users accessing the Website, facilitating the use of online content etc.

The information encoded in cookies may also include personal data, such as, in particular, the IP address from which the connection is made, a user name, an e-mail address or a unique identifier.

In addition to cookies, there are also other tracking tools which allow to achieve the same purposes in different ways, such as pixels or other tools that merely observe users’ behaviour. For the purposes of this information notice, the term 'cookie' shall mean any tracking tool. 

WHAT TYPES OF COOKIES DO WE USE?

We use both session cookies (that are automatically deleted from your device at the end of your navigation on the Website) and persistent cookies (that are stored on your terminal once the session has ended).

 

ADR uses first-party cookies (i.e. with the same domain as the Website) and so-called third-party cookies, which originate from other websites that we host on our website.

First and foremost, ADR uses technical cookies (the installation of which does not require your consent) in order to ensure the Website operates properly, provide users with the requested services and keep track of consents to the installation of the types of cookies that so require; these cookies are used for the sole purpose of ‘carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contracting party or user to provide that service’ (see Section 122 (1) of the Privacy Code).

 

In addition, ADR uses analytical cookies in order to compile statistics and understand how the website is used by users. The use of analytical cookies is equated with the use of technical cookies if:

 

(i) they are only used to produce aggregate statistics and in relation to a single website or mobile application;

(ii) at least the fourth component of the IP address is concealed for those of third parties;

(iii) third parties refrain from combining analytical cookies thus minimised with other processing (e.g. customer files or statistics of visits to other sites) or from passing them on to other third parties. However, third parties are permitted to compile statistics with data from several domains, websites or apps that can be traced back to the same publisher or business group.

 

In particular, ADR uses ‘Google Analytics’ analytical cookies to monitor and verify your use of the Website. Thanks to Google Analytics, ADR is able to know the ‘traffic’ on its website, the number of times a user opens a piece of multimedia content - whether audio or video - the number of people who view it and who close it before it is finished. Please note that according to the qualifications indicated by the Italian Data Protection Authority within the Guidelines on cookies, Google Analytics (hereinafter also referred to as ‘GA 4’) is assimilated to a technical cookie, as it anonymises the IP address of the device from which the connection is made - thus not allowing it to be identified - and allows only aggregate data to be obtained for the purpose of carrying out statistical analyses on the Website's performance. GA 4 will be enabled for any and all users of the Website, including those who choose to click on the ‘X’ in the top right-hand corner of the cookie banner or not to give their consent to the use of cookies that require it via the ‘REJECT ALL’ command in the ‘MANAGE YOUR COOKIES’ section. Enabling this command will result in all cookies being rejected, except technical ones.

 

Enabling Google Analytics may entail the transfer of personal data outside the European Economic Area: following Google LLC's adherence to the Data Privacy Framework (hereinafter ‘DPF’), such data transfers are permitted on the basis of an adequacy decision adopted by the European Commission pursuant to Article 45 of the GDPR and are carried out in compliance with the provisions contained in Chapter V of the Regulation.

 

Lastly, based on the user's consent, ADR may install profiling cookies on your device, which are essential for analysing the profile, behaviour and actions of individuals browsing the Website. These types of cookies (first-party and third-party) make it possible to: understand which content a user is interested in; send advertising messages in line with the preferences expressed by the user when using features and surfing the web; carry out analysis and monitoring of user behaviour; allow a user to carry out communications and interactions through social networks.

 

Profiling cookies and analytical cookies that cannot be assimilated to technical cookies can be activated when accessing the Website via the special preferences management dashboard accessible from the information banner and, in the same way, can be disabled at any time.

 

Furthermore, the Website incorporates and gives you the possibility of viewing videos and multimedia content directly from its pages (so-called ‘embed’) located on third-party platforms. In this respect, the website uses players made available by YouTube. Clicking on the video starts playback and at the same time, third-party cookies are installed on your device. In any case, to ensure that you have full choice as to whether or not to use these technologies and cookies, a warning will be shown by default when trying to watch the video - unless you have previously accepted the use of all cookies or this specific technology (in which case the video will be played automatically) - which will inform you of the use of these tools and give you the option to activate this ‘embed’ video playback feature and accept the installation of the relevant cookies. Conversely, if you do not wish to allow us to use this technology, you can still view the video by redirecting to the portal where it is available. FOR HOW LONG DO WE RETAIN YOUR PERSONAL DATA?

Beyond the times indicated in the preceding tables regarding the permanence of cookies on its terminal, ADR retains the personal data collected through these tracking tools for the time strictly necessary to achieve the purposes for which they are collected; specifically:

• personal data collected through technical cookies are deleted 12 months after the last browsing session ;
• personal data collected through technical cookies are deleted 24 months after the last session ; 
• personal data collected through profiling cookies will be processed until you withdraw your consent. Personal data collected through profiling cookies are processed the last 12 months. ; 

WHERE IS THE INFORMATION COLLECTED THROUGH COOKIES PROCESSED?

The information collected through cookies is mainly processed within the European Economic Area (EEA). Certain third-party cookies, such as GA 4, may however entail a transfer of the relevant information outside the EEA; in this case, ADR has taken additional technical and organisational measures in order to guarantee the security of any personal data transmitted with the information collected by the cookies, favouring the anonymisation of such data where this is possible. In any case, any transfer (by way of example, where there is an adequacy decision by the European Commission towards the third country pursuant to Article 45 of the GDPR or when the transfer is made following adequate safeguards pursuant to Article 46 of the GDPR) is carried out in compliance with Chapter V of the Regulation.
